Welcome to TwistedInk. These Terms of Service ("Terms") govern your use of our website and your purchase of products or services from TwistedInk.

By visiting our website, placing an order, or purchasing products or services from us, you agree to these Terms, along with our Privacy Policy, Shipping Policy, Return Policy, and any other policies posted on our website.

If you do not agree to these Terms, please do not use our website or purchase our products or services.

1. Online Store Terms

By using our website, you represent that you are at least the age of majority in your state or place of residence or that you have permission from a parent or legal guardian to use this website.

You may not use our products, services, website, designs, photographs, or other content for any unlawful or unauthorized purpose.

You may not transmit viruses, malicious code, or other material intended to damage, interfere with, or disrupt our website or services.

Violation of these Terms may result in termination of your access to our website or cancellation of an order.

2. Products and Services

TwistedInk offers products that may include, but are not limited to:

  • Custom and ready-to-purchase apparel

  • Embroidered items

  • Direct-to-film (DTF) printed products

  • Sublimation products

  • Hats and accessories

  • Drinkware

  • Personalized and custom merchandise

  • Other products offered through our website

Many TwistedInk products are made to order or customized specifically for the customer.

We make every reasonable effort to display product colors, photographs, descriptions, and details accurately. However, actual colors may vary slightly due to differences in computer monitors, mobile devices, garment manufacturers, fabric materials, printing processes, and product batches.

Small variations in placement, color, sizing, stitching, printing, or other characteristics are normal with handmade, embroidered, sublimated, or custom-produced products and are not necessarily considered defects.

3. Custom and Personalized Orders

Customers are responsible for reviewing all personalization information, including names, dates, numbers, spelling, colors, sizes, and other custom details before submitting an order.

TwistedInk is not responsible for customer-provided spelling errors, incorrect information, incorrect sizing selections, or other information entered incorrectly by the customer.

Once production has begun, customized or personalized orders generally cannot be changed or canceled.

Custom, personalized, made-to-order, or specially produced merchandise may not be eligible for return or exchange unless the item arrives damaged, defective, or was produced incorrectly due to an error on our part.

4. Custom Artwork and Design Approval

When TwistedInk provides a design proof or mockup for approval, it is the customer's responsibility to carefully review the design before approving production.

Approval of a proof confirms acceptance of the design, including spelling, layout, colors, sizing, placement, and other visible details.

Once a design has been approved and production has begun, changes may not be possible and additional charges may apply if changes or replacements are requested.

Colors shown on digital proofs may vary slightly from the finished product due to screen settings, printing methods, thread colors, garment materials, and manufacturing differences.

5. Customer-Provided Artwork and Intellectual Property

By submitting artwork, logos, photographs, trademarks, wording, graphics, or other materials to TwistedInk for reproduction, you represent that you own the material or have permission from the copyright, trademark, or other rights holder to use and reproduce it.

You are responsible for obtaining any necessary permissions, licenses, or authorizations.

TwistedInk reserves the right to refuse an order that we reasonably believe may violate copyright, trademark, intellectual property, privacy, publicity, or other applicable rights.

The customer assumes responsibility for claims arising from unauthorized materials supplied to TwistedInk.

6. TwistedInk Intellectual Property

Unless otherwise stated, the content of our website, including original photographs, graphics, logos, product descriptions, designs, branding, and other original content created by TwistedInk, is owned by or licensed to TwistedInk and may not be copied, reproduced, distributed, resold, or used commercially without permission.

Purchasing a physical product from TwistedInk does not automatically transfer ownership of the underlying artwork, design files, embroidery files, digital files, or other intellectual property associated with that product.

7. Pricing and Product Information

All prices are listed in U.S. dollars unless otherwise stated.

Prices, promotions, product availability, specifications, and product descriptions may change at any time without notice.

We reserve the right to correct typographical errors, pricing errors, product descriptions, or other inaccuracies.

If an error affects an order you have already placed, we may contact you with available options or cancel the affected portion of the order and issue any applicable refund.

8. Orders

We reserve the right to accept, refuse, limit, or cancel an order at our discretion when reasonably necessary, including situations involving:

  • Suspected fraud

  • Payment issues

  • Incorrect pricing

  • Product availability

  • Production limitations

  • Suspected unauthorized use of copyrighted or trademarked materials

  • Errors in product information

  • Orders that violate these Terms

If we cancel an order after payment has been processed, the applicable amount will be refunded to the original payment method.

Submitting an order does not guarantee acceptance until the order has been processed and accepted by TwistedInk.

9. Payment

Payment is due according to the payment options provided during checkout.

By providing payment information, you represent that you are authorized to use the payment method provided.

Payment information may be processed by Shopify, Shopify Payments, or other third-party payment providers. TwistedInk does not control the independent policies or operations of third-party payment processors.

10. Taxes

Applicable sales tax may be collected based on the customer's order, shipping destination, pickup location, and applicable tax laws.

Customers are responsible for any taxes, duties, customs charges, or other fees that may apply to their purchases unless otherwise required by law.

11. Shipping and Processing

Most TwistedInk products are made to order.

Typical processing time is approximately 3–7 business days, unless otherwise stated on the product listing or communicated to the customer.

Processing time does not include shipping or carrier transit time.

Business days do not include weekends or holidays.

Certain custom, personalized, embroidered, large-quantity, or specialty orders may require additional production time.

Estimated delivery dates provided during checkout or by shipping carriers are estimates and are not guaranteed by TwistedInk.

12. Lost, Stolen, or Delayed Packages

TwistedInk is not responsible for shipping carrier delays that occur after an order has been transferred to the carrier.

Once tracking information indicates that a package has been delivered, TwistedInk is not responsible for packages that are subsequently missing or stolen, except where otherwise required by applicable law.

Customers should contact the applicable shipping carrier, including USPS when applicable, regarding delivery or tracking concerns.

If shipping protection through Route was purchased with your order, claims should be submitted according to Route's applicable terms and claim procedures.

13. Returns, Exchanges, and Store Credit

Returns and exchanges are governed by our posted Return Policy.

Unless otherwise stated in our Return Policy:

  • Eligible returns are issued as store credit.

  • Returns or exchanges must generally be initiated within 10 days of receiving the order.

  • Returned merchandise must be unworn, unwashed, unused, and in its original condition.

  • Customers are generally responsible for return and exchange shipping costs.

  • Shipping charges are generally non-refundable.

  • Custom and personalized products may be final sale unless defective or produced incorrectly due to an error on our part.

Items showing signs of wear, washing, stains, makeup, excessive pet hair, smoke, perfume, or other odors may be refused.

14. Order Cancellations

Because many of our products are made to order, cancellation requests must be submitted as soon as possible.

We cannot guarantee that an order can be canceled once production has started.

Custom or personalized orders that have already entered production may not be eligible for cancellation or refund.

15. Local Pickup

When local pickup is offered, customers are responsible for selecting the appropriate pickup option during checkout and following the pickup instructions provided by TwistedInk.

Customers will be notified when their order is ready for pickup.

Please do not arrive to collect an order until you have received confirmation that it is ready.

Additional pickup instructions may be provided directly to customers after an order is placed. For privacy and security purposes, pickup details do not need to be publicly displayed within these Terms.

16. Gift Cards and Store Credit

Gift cards and store credit, when offered, are subject to any additional terms displayed at the time they are issued or purchased.

Store credit generally has no cash value and cannot be exchanged for cash except where required by law.

17. Third-Party Services and Links

Our website may contain links to or integrations with third-party websites, payment processors, shipping carriers, applications, social media platforms, or other services.

TwistedInk is not responsible for the content, policies, availability, security, or practices of independent third-party services.

Your use of third-party services may be subject to their own terms and privacy policies.

18. Reviews, Photos, and Customer Content

If you submit a review, photograph, testimonial, comment, social media tag, or other content to TwistedInk, you represent that you have the right to submit that material.

We may request permission to share customer photos, reviews, or other content for promotional purposes.

We will not knowingly publish private customer information as part of promotional content without authorization.

19. Prohibited Uses

You may not use our website or its content:

  • For unlawful purposes

  • To violate intellectual property rights

  • To harass, threaten, abuse, or discriminate against others

  • To submit false or misleading information

  • To distribute malicious software

  • To collect another person's personal information without authorization

  • To interfere with website security

  • To engage in fraudulent transactions

  • To copy, reproduce, or commercially exploit TwistedInk content without authorization

We work to provide accurate information and quality products; however, except for warranties that cannot legally be excluded, products and services are provided on an "as is" and "as available" basis.

We do not guarantee that our website will always be uninterrupted, timely, secure, or error-free.

Nothing in these Terms is intended to limit rights or warranties that cannot legally be waived under applicable consumer protection laws.

22. Limitation of Liability

To the fullest extent permitted by applicable law, TwistedInk will not be liable for indirect, incidental, special, consequential, or similar damages arising from your use of our website, products, or services.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

To the extent permitted by law, you agree to indemnify and hold TwistedInk harmless from claims, losses, damages, liabilities, or expenses arising from your violation of these Terms, your misuse of our website or services, or materials you provide to us without proper authorization.

24. Privacy

Your submission of personal information through our website is governed by our Privacy Policy.

Payment and certain customer information may also be processed by Shopify or other service providers according to their applicable privacy policies.

25. Severability

If any portion of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions will continue to remain in effect to the fullest extent permitted by law.

26. Termination

These Terms remain effective unless terminated by you or TwistedInk.

We may suspend or terminate access to our services when reasonably necessary because of fraud, misuse, violation of these Terms, unlawful activity, or other conduct that could harm TwistedInk, our customers, or third parties.

27. Governing Law

These Terms and any transactions with TwistedInk will be governed by applicable laws of the United States and the State of Missouri, without limiting any consumer rights that apply under applicable law.

We reserve the right to update or modify these Terms from time to time.

Changes will be posted on this page with an updated revision date. Your continued use of our website after changes become effective constitutes acceptance of the updated Terms to the extent permitted by law.

These Terms, together with our Privacy Policy, Return Policy, Shipping Policy, and other policies posted on our website, constitute the agreement between you and TwistedInk concerning your use of our website and purchases from us.
